§ 1 Scope       

1. These general terms and conditions apply to all orders placed through our online shop at www.splendido.at. To view all our company information, please visit our Legal Notice page .
2. A consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to his or her commercial nor to his or her independent professional activity.
3. The following General Terms and Conditions govern the contractual relationship between Splendido eU and the customer in the version valid at the time of the order. Deviating terms and conditions of the customer are not recognized unless Splendido eU has expressly agreed to their validity in writing.
4. These Terms and Conditions are available at any time on our website and can be printed or downloaded by you.
5. We reserve the right to change our Terms and Conditions (T&Cs) at any time. Any changes will take effect when the updated T&Cs are published on our websites. Any purchase agreement concluded between you and us will be subject to the version of the T&Cs in effect at the time you order products through the websites.
6. The contractual language is German. All communication, contracts, and information are provided in German . In the event of any discrepancies between different language versions of these Terms and Conditions or other contractual documents, the German version shall prevail and be legally binding. Any automatic translations of these Terms and Conditions or other contractual documents into languages ​​other than German are provided solely for the information and support of our international customers. We assume no responsibility or liability for the accuracy, completeness, or timeliness of these automatic translations. In the event of any discrepancies between the German version and an automatic translation, the German version shall prevail.

§ 2 Conclusion of the contract

1. The purchase contract is concluded with Splendido eU, Dayana Bahchevanova, (Neubaugasse 24, Graz 8020), info@splendido.at. The identity of the seller can be found on the imprint page .
2. The presentation of the products in the online shop for silver and gold jewels and jewelry serves only as a visual presentation and does not constitute a legally binding offer. It is intended to encourage customers to place an order, but the contract is only concluded upon acceptance of the order by the seller .
3. We do not verify the accuracy of the data you submit and therefore assume no liability for any errors.
4. We do not accept orders where the specified delivery address belongs to a company or individual that provides freight forwarding services. Should we mistakenly accept such an order, we reserve the right to cancel the order after prior notification via email or telephone.
5. You have the option of submitting a binding purchase offer (order) via our online shopping cart system. Your purchase in our shop is completed in the following steps:

• You add the items to your shopping cart by clicking the "Add to cart" button.
• By clicking on the shopping bag icon in the navigation bar, you can view all the items currently in your shopping cart. From there, you can make changes at any time.
• To complete your purchase, please click the "Checkout" button. This will take you to the final step, called "Checkout."
• There, you'll be asked to enter all the required information, including your personal information and shipping details. You can also select your preferred payment option.
• By clicking the "Pay Now" button, you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.
• The automatic order confirmation documents that we have received the order, but does not constitute acceptance of the offer. The purchase contract is only concluded upon dispatch of our order confirmation by email or upon delivery of the goods.
• If you have a customer account, you can view your order details in your account.

§ 3 Prices

1. The prices stated on the product pages include VAT.
2. We reserve the right to change the prices of our products at any time. The prices stated at the time of order are binding.
3. If a product is listed at an incorrect price due to a typographical error or system error, we reserve the right to cancel or correct any orders placed at the incorrect price.
4. In addition to the stated product prices, shipping costs apply. Please see Section 5 below for the exact shipping costs.
5. All prices are quoted in euros (€). Exchange rate fees may apply to international orders.
6. Before completing the order, the total price, including all additional costs such as shipping and taxes, will be displayed.

§ 4 Delivery and delivery conditions

1. Splendido eU delivers to addresses within Austria and to Belgium, Denmark, Germany, Estonia, Finland, France, Greece, Ireland, Italy, Croatia, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Portugal, Sweden, Slovakia, Slovenia, Spain, Czech Republic, Hungary and Cyprus.
2. Delivery times are typically 3-5 business days, unless otherwise stated. Any deviations will be indicated on the respective product page. Please note that delivery times may vary depending on the selected country.
3. Orders received before 12:00 noon from Monday to Friday will be dispatched no later than the next working day, unless this day is a public holiday.
4. We offer optional express delivery within Austria for an additional charge of €12. Your order will leave our warehouse the next business day and should arrive by 1:00 PM the following day.
5. We accept no responsibility for any delays caused by the various delivery services we use.
6. If not all ordered products are in stock, we are entitled to make partial deliveries, provided this is reasonable for you. Additional shipping costs will only be charged if expressly agreed.
7. Should delivery of the goods fail due to your fault despite three delivery attempts, we reserve the right to withdraw from the contract. Any payments made will be refunded immediately, less the shipping costs.
8. If the ordered product is unavailable because our suppliers fail to supply us with this product through no fault of our own, we may withdraw from the contract. In this case, we will notify you immediately and, if necessary, offer to deliver a comparable product. If no comparable product is available or you do not wish to receive a comparable product, we will promptly refund any consideration already paid.

§ 5 Shipping costs

1. For orders under €150, we charge a shipping fee of €6.00 ​​at the listed prices. Shipping costs are clearly stated on the product pages, in the shopping cart system, and on the order page.

2. For orders over €150, we offer free shipping throughout the EU. For deliveries within the EU under €150, we charge a flat rate of €16.

3. In the case of cross-border deliveries, additional taxes (e.g. in the case of an intra-community acquisition) and/or duties (e.g. customs duties) may be incurred in individual cases, which must be paid by the customer.

4. The buyer bears the costs for the return and the responsibility

§ 6 Return Policy & Right of Withdrawal

1. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods, provided that you have ordered one or more goods as part of a single order and these are or will be delivered as a single order.
2. To exercise your right of withdrawal, you must inform us ([your first name, surname], [your address], [your telephone number], [your email address]) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email).
3. To exercise your right of withdrawal, we recommend that you submit your withdrawal declaration using the form below. Please send the completed form to our business email address: widerruf@splendido.at .
4. In the event of a cancellation, you will bear the direct cost of returning the goods, unless the goods were delivered incorrectly by us or are defective. In these cases, we will send you a return label immediately. If this is not possible, we will reimburse you for the return shipping costs if you return a package to us from an EU country.
5. The right of withdrawal does not apply to the delivery of goods that are manufactured according to customer specifications or are clearly tailored to personal needs.
6. Returned goods must be unused, undamaged, and in their original packaging to qualify for a full refund.
7. You are solely responsible for the return shipment and any possible loss of value of the goods resulting from use beyond checking their quality, properties and functionality.
8. The cancellation is considered complete once the items have been received and inspected by us. We will process your refund immediately after inspection.
9. We reserve the right to make an appropriate deduction from the refund for returned jewelry items with damaged packaging.
10. For returns of almost all items, the label must be intact. Items returned without a label cannot be refunded.

 

§ 7 Payment

1. Payment can be made either in advance via bank transfer or we offer PayPal, credit card, Shop Pay, Apple Pay, Google Pay, EPS and Klarna Sofortüberweisung.
2. We reserve the right to cancel orders placed using suspicious or dubious payment methods. In such cases, we will contact you immediately to clarify the situation and, if necessary, arrange an alternative payment method.
3. If you use alternative payment methods other than direct bank transfers, the privacy policies of the respective payment providers apply. These policies explain how your personal information is collected, stored, processed, shared, and transferred when you use their services.
4. If you choose to pay in advance by bank transfer, we will provide you with our bank details and deliver the goods after receiving your payment. Please note that processing your payment may take 2-3 business days, which may affect shipping and lead to corresponding delays. Please note that you have seven business days to complete the transfer. If payment is not received within this period, we reserve the right to withdraw from the purchase contract.
5. Only one discount code can be redeemed per order.
6. Splendido eU vouchers with a voucher code cannot be used to purchase additional gift cards at www.splendido.at . Splendido eU is not liable for loss, theft, or damage to gift cards. Multiple gift cards can be used per order, and their value will be automatically deducted from the total amount of the current order. Any remaining balance can be paid using other available payment methods.
7. The deduction of a discount is only permitted if this has been expressly agreed.

8. If you pay by credit card, your credit card account will be charged upon completion of your order. For other payment options, the charge will be made according to the respective terms and conditions at the time of order processing.

9. Cash payment of online gift vouchers is generally not possible, neither in full nor in part.

§ 8 Retention of title

1. The goods remain our property until the purchase price has been paid in full.
2. Before transfer of ownership, pledging, transfer by way of security, processing or modification is not permitted without our consent.

 

§ 9 Data Protection

§ 10 Warranty

1. The statutory warranty applies to all jewelry sold. This guarantee states that the jewelry is free from material defects and meets the agreed quality standards at the time of delivery.
2. Warranty claims expire after 2 years from the date of delivery of the goods.
3. The representation of the products may differ from the actual appearance of the delivered goods.
4. In the event of a defect, we reserve the right to repair the piece of jewelry or replace it with an equivalent item. Please note that this process may take several weeks.
5. The warranty does not cover damage caused by improper handling or normal wear and tear.

Miscellaneous :

• The goods must be returned within fourteen days to meet the deadline. The buyer is responsible for the return shipping costs. The purchase price will be refunded using the payment method selected when ordering.
• You are solely responsible for the return shipment and any possible loss of value of the goods resulting from use beyond checking their quality, properties and functionality.

• The European Commission provides a platform for online dispute resolution (ODR), which you can find at http://ec.europa.eu/consumers/odr . Our email address is [your email address]. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
