§ 1 Scope
These general terms and conditions apply to all orders placed through our online shop at www.splendido.at. All company data can be viewed on our imprint page.

A consumer within the meaning of these terms and conditions is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional.

The following terms and conditions govern the contractual relationship between Splendido e.U. and the customer in the version valid at the time of the order. Deviating conditions of the customer are not recognized unless Splendido e.U. has expressly agreed to their validity in writing.

These terms and conditions are always available on our website and can be printed or saved by you. We reserve the right to change these terms and conditions at any time. All changes take effect upon publication on our website. The version of the terms and conditions valid at the time of the order applies to each concluded purchase contract.

The contract language is German. In case of discrepancies between the German version and a translation, only the German version is legally binding. Automatic translations are for information purposes only and do not establish any legal claims.

§ 2 Conclusion of the contract

The presentation of products in the online shop serves only as a visual display and does not constitute a legally binding offer. The contract is only concluded through our explicit order confirmation by email or by delivery of the goods. The automatic order confirmation after placing the order does not yet constitute acceptance of the offer.

We do not verify the accuracy of the data you provide and therefore assume no liability for any errors in the customer's information.

We do not accept orders where the specified delivery address belongs to a company or person offering freight forwarding services. If we accidentally accept such an order, we reserve the right to cancel it after prior notification by email.

The ordering process proceeds as follows:
Add the desired product to the shopping cart (button "Add to Cart")
Check the shopping cart and adjust if necessary
Proceed to checkout via the "Checkout" button
Enter personal data, delivery address, and preferred payment method
By clicking the "Pay Now" button, you place a binding order

The purchase contract is concluded as soon as we accept your order by sending an order confirmation via email or by shipping the goods. If you have a customer account, you can view your order data there at any time.

§ 3 Prices
All prices stated on the product pages include statutory VAT and are in euros (€). We reserve the right to change prices at any time. Only the price displayed at the time of order is binding.

If a product is offered at an obviously incorrect price due to a technical or editorial error, we reserve the right to cancel or correct affected orders. The customer will be informed immediately in this case.

Shipping costs are stated in § 5 of these terms and conditions as well as on the product pages, in the shopping cart, and on the order page. Before completing the order, the total price including all applicable costs will be displayed.

For international orders, currency exchange fees may apply, which are to be borne by the customer.

§ 4 Delivery and Delivery Conditions
Splendido e.U. currently delivers only to delivery addresses within the following countries:

- Austria (AT)
- Germany (DE)
- Netherlands (NL)

An expansion of the delivery area to other EU countries is in preparation. Orders from other countries can be registered on our waiting list to be preferentially informed when launching in your country.

The delivery time is usually 3–5 working days unless otherwise stated on the respective product page. Delivery times may vary depending on the destination country.

Orders received Monday to Friday before 12:00 p.m. will be shipped no later than the second following working day, provided that day is not a public holiday.

Optionally, we offer express delivery within Austria for an additional charge of €12. The order leaves our warehouse the next working day and should arrive at the customer by 1:00 p.m. the following day.

We accept no liability for delays caused by commissioned shipping service providers.

If not all ordered products are in stock, we are entitled to make partial deliveries, provided this is reasonable for the customer. Additional shipping costs for partial deliveries will only be charged by express agreement.

If delivery of the goods fails despite three delivery attempts due to the customer's fault, we reserve the right to withdraw from the contract. Payments made will be refunded immediately, minus the incurred shipping costs.

If an ordered product is permanently unavailable because we are not supplied by our suppliers through no fault of our own, we may withdraw from the contract. In this case, we will inform the customer immediately and, if applicable, suggest a comparable product. If rejected, the purchase amount will be fully refunded.

§ 5 Shipping Costs
Splendido e.U. offers free shipping for all orders to the following countries, regardless of order value:

- Austria (AT): free shipping
- Germany (DE): free shipping
- Netherlands (NL): free shipping

An express delivery option within Austria can be chosen for an additional charge of €12 (see § 4).

Shipping costs are shown on the product pages, in the shopping cart, and on the order page before completing the order.

For cross-border deliveries, additional taxes (e.g., within the scope of an intra-community acquisition) and/or customs duties may apply in individual cases, which must be borne by the customer.

The costs of returns are borne by the buyer unless otherwise regulated in § 6. An estimate of the return shipping costs can be found in § 6.

§ 6 Returns & Withdrawal Rights
All items are carefully inspected, checked, and documented before shipping to ensure they meet our quality standards.

Voluntary 30-day return policy
As a special service, we grant our customers a voluntary return policy of 30 days from receipt of the goods — this goes beyond the statutory minimum period of 14 days and represents a voluntary service provided by Splendido e.U.

To exercise your right of withdrawal, please inform us by means of a clear statement (e.g., by email) of your decision to withdraw from the contract. We recommend using the withdrawal declaration by email to: widerruf@splendido.at

The returned goods should be sent back as undamaged as possible, with the original packaging and original labeling. However, you have the right to inspect the goods to the extent that would have been possible in a retail store. For any depreciation beyond this, we reserve the right to claim reasonable compensation for loss of value in accordance with § 16 FAGG.

Return shipping costs — estimate
The immediate costs of the return shipment are borne by the buyer — except in cases of incorrect deliveries or proven defects. In these cases, we will promptly provide the customer with a free return label. If this is not possible, we will reimburse the return shipping costs.

Estimated return shipping costs depending on the destination country (standard shipping with tracking number):

- Austria (AT): approx. €5–8
- Germany (DE): approx. €6–10
- Netherlands (NL): approx. €10–15

We recommend returns with a tracking number (e.g., parcel shipping with tracking), as the buyer bears the shipping risk until the goods are received by us.

Exclusion of the right of withdrawal
The right of withdrawal does not apply to goods that are made to customer specifications or clearly tailored to the personal needs of the customer.

Customer responsibility
The customer is responsible for the return shipment as well as any possible loss in value of the goods resulting from use beyond the mere examination of the condition, properties, and functioning.

Completion of cancellation
The cancellation is considered complete as soon as the items have been received and inspected by us. The refund will be made immediately after the inspection is completed via the payment method chosen at the time of order.

We reserve the right to deduct a reasonable amount from the refund for returned damaged jewelry or damaged packaging.

§ 7 Payment
Payment can be made optionally by prepayment via bank transfer. In addition, we offer the following payment methods: PayPal, credit card (Visa, Mastercard, American Express), Shop Pay, Apple Pay, Google Pay, EPS, Klarna Sofortüberweisung, and USDC stablecoin.

We reserve the right to cancel orders made with suspicious or questionable payment methods. In such cases, we will contact the customer immediately to clarify the situation and, if necessary, agree on an alternative payment method.

When using alternative payment methods that do not include direct bank transfer, the privacy policies of the respective payment providers apply regarding the collection, storage, and processing of personal data.

Prepayment by bank transfer: After receiving your order, we will provide you with our bank details. Delivery will take place after payment has been received. Please allow a processing time of 2–3 business days. The transfer must be received within 7 business days of the order date. If payment is not received within this period, we reserve the right to withdraw from the purchase contract.

USDC (USD Coin): We accept USDC payments via Shopify Payments on the Base network. The paid USDC amount is automatically converted into euros and credited to your purchase — without additional exchange fees. Please note that the customer must hold USDC on the Base network. USDC on other networks (Ethereum, Solana, Polygon) must be bridged to Base before payment. Chargebacks for USDC payments are handled manually. Subscription payments are not possible with USDC.

Credit Card: The credit card account will be charged upon completion of the order. For all other payment options, the debit will be made according to the terms of the respective provider.

Only one discount code can be redeemed per order. Voucher codes from Splendido e.U. cannot be used to purchase additional gift cards. Splendido e.U. is not liable for loss, theft, or damage of gift cards. Multiple gift cards can be redeemed per order, with their value automatically deducted from the total amount. Any remaining balance can be paid using other available payment methods.

The deduction of a discount is only permitted after explicit written agreement. Cash payment for online gift vouchers is generally not possible, neither in full nor in part.

§ 8 Retention of Title
The delivered goods remain the property of Splendido e.U. until full payment of the purchase price, including all incidental costs, has been made.

Before full transfer of ownership, pledging, security transfer, processing, or alteration of the goods is not permitted without the express written consent of Splendido e.U.

§ 10 Warranty
All sold jewelry is subject to the statutory warranty. The jewelry is free from material defects and has the agreed quality at the time of handover. Warranty claims expire 2 years after the date of delivery.

In the case of a verifiable defect, we reserve the right to repair the jewelry or exchange it for an equivalent piece. This process may take several weeks. The customer will be informed about the procedure.

The warranty does not cover damages resulting from improper handling, lack of care, or normal wear and tear.

The presentation of products in the online shop may slightly differ from the actual appearance of the delivered goods, especially regarding color and size representation on different screens.

§ 11 Applicable law
The law of the Republic of Austria applies, excluding the UN Sales Convention (CISG). Mandatory consumer protection provisions of the country where the consumer has their habitual residence remain unaffected by this choice of law.

§ 12 Jurisdiction
For disputes arising from or in connection with this contract, the locally competent court in Graz, Austria, shall have jurisdiction, as far as legally permissible. For consumers residing in another EU member state, the mandatory jurisdiction rules of the respective country apply.

§ 13 Miscellaneous

Returns must be received by us within 30 days of receipt of the goods. The buyer bears the return shipping costs (estimate see § 6). The refund of the purchase price will be made via the payment method chosen at the time of order, no later than 5–7 business days after receipt and inspection of the return.

The customer is responsible for the return shipment as well as any possible loss in value of the goods resulting from use beyond the mere examination of the condition, properties, and functioning.

We are not legally obliged to participate in dispute resolution proceedings before a consumer arbitration board, but we are generally willing to resolve disputes amicably and in the interest of the customer.
